Welcome to Butterbrot. These Terms of Use ("Terms") govern your access to and use of the Butterbrot mobile application for iOS ("Application"). Please read these Terms carefully before downloading or using the Application.
By downloading, installing, or using the Application, you agree to be legally bound by these Terms. If you do not agree to these Terms, you may not download, install, or use the Application. We reserve the right to modify these terms at any time, and your continued use of the app signifies your acceptance of any changes.
You acknowledge that these Terms are concluded solely between you and Exercise Is Gratitude, LLC, and not with Apple Inc. Exercise Is Gratitude, LLC is solely responsible for the Application and its content. Your use of the Application must comply with the Apple Media Services Terms and Conditions (App Store Terms of Service).
We grant you a non-exclusive, non-transferable, revocable license to use the Butterbrot software on any Apple-branded products that you own or control, as permitted by the usage rules set forth in the App Store Terms of Service.
All intellectual property rights in the Application—including but not limited to the source code, design layouts, user interfaces, visual graphics, logos (such as the 🍞 asset), and branding text—are owned entirely by us. You may not copy, reverse-engineer, modify, decompile, or distribute any part of the Application software.
In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, Exercise Is Gratitude, LLC, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You agree to use the Application only for personal, non-commercial, and lawful purposes. You agree not to attempt to disrupt the operational integrity of the software or use any automated tools to extract data from the Application structure.
The Application is provided to you on an "AS IS" and "AS AVAILABLE" basis, without warranty of any kind, either express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Application will meet your requirements, run completely error-free, or function continuously without temporary interruptions.
To the maximum extent permitted by law, in no event shall Exercise Is Gratitude, LLC or its developers be liable for any direct, indirect, incidental, special, or consequential damages. This includes, without limitation, damages for loss of profits, data loss, hardware damage, scheduling malfunctions, or any other intangible losses resulting from your use of or inability to use the Application.
You acknowledge that Exercise Is Gratitude, LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of it, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
Exercise Is Gratitude, LLC is solely responsible for providing any maintenance and support services for the Application. You acknowledge that Apple Inc. has absolute zero obligation whatsoever to furnish any maintenance and support services with respect to the Application.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
These Terms shall be governed by, interpreted, and enforced in accordance with the laws of your home country/state, without regard to its conflict of law principles. Any legal actions or proceedings arising out of these Terms must be brought in a court of competent jurisdiction.
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
We also reserve the right, without notice and in our sole discretion, to terminate your license to use the Application and to block or prevent your future access if you violate any of these Terms. Upon termination, you must cease all use of the Application and delete all copies from your devices.
